(WECC) has some interest in utilizing the <br />Hawk's Nest silos and adjoining ground storage area and <br />has contacted the Denver and Rio Grande Western <br />Railroad Company and Somerset Mining Company, the <br />owners of the above properties, respectively. It is <br />our understanding that the former owner of the Hawk's <br />Nest facilities has forfeited the reclamation bond and <br />the Division has begun reclaiming the area. <br />Should WECC arrange to utilize one or both of these <br />facilities, how would the Division handle the bonding <br />liability? Doesn't the State already have the funds in <br />hand to reclaim these areas, as part of the forfeited <br />reclamation bond? Couldn't the portion of the bond <br />calculated for the silos and ground storage reclamation <br />continue to be held by the Division for bonding this <br />reclamation at a later date? <br />Though WECC has not completed a detailed evaluation of <br />the silo, truck dump, and ground storage sites, it <br />appears that these areas require some clean-up work to <br />meet current performance standards (i.e. for soils, <br />drainage, sediment pond design, etc.). Could a portion <br />of the reclamation bond funds be utilized to complete <br />this clean-up work before WECC utilizes the site(s)? <br />At least, wouldn't the Division proceed with the <br />reclamation of any adjoining disturbed areas not <br />proposed to be <br />utilized? <br />AMGOE'.C= <br />
