It is our understanding that a surface <br />landowner at the Raton Creek Mine wishes to extract some gravel from his property. The area <br />from which he wishes to remove this gravel is within an area that has been disturbed in <br />conjunction with the Raton Creek underground coal mine. This potential gravel-extraction area is <br />situated within an azea that has been regraded, retopsoiled, and reseeded, and has been granted a <br />Phase I bond release by our Division. <br />The approved post-mining land use for the Raton Creek mine is "rangeland" (DMG Permit page <br />533). The Division believes that the existence of a gravel extraction area used in support of the <br />approved post-mining land use could be allowed, under the following circumstances: <br />Energy Fuels Mining Company (EFMC) revises its permit to describe how this <br />disturbance will be used in support of the post-mining land use (Rule 2.05.5(2)(a)(i)). <br />2. In revising its permit to describe this disturbance, EFMC identifies the dimensions, <br />including depth and grades, and the location of [his gravel extraction area (Rule <br />2.05.3(2)(b)). <br />3. EFMC revises its permit to indicate how reclaimed areas immediately adjacent to this <br />extraction azea will be protected from being redisturbed or otherwise adversely affected <br />by the proposed gravel extraction activities. This would include a description of any <br />measures proposed to prevent downgradient areas from receiving erosive or sediment- <br />laden runoff from the gravel extraction area (Rule 4.15.1(3)). <br />EFMC revises its permit [o describe whether the gravel area will be reclaimed in <br />accordance with the reclamation standards for the other disturbances at the Raton Creek <br />mine, or whether the gravel area will be ]eft unreclaimed (Kule 2.05.4(1), 4.15(2)). <br />
