<br />iii ii iiu iii <br />~vcc <br />Yampa Valley Coal Corporation 29588 Routt County Road X27 <br />,July 15, 1986 Oak Creek, Colorado 80467 <br />(303) 879-3800 <br />Mr. Dan Mathews <br />Reclamation Specialist <br />Colorado Mined Land <br />Reclamation Division <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />RE: Response to Stipulation No. 15, Mine No. 3 <br />Permit C-84-062 <br />Dear Mr. Mathews: <br />Stipulation 15 states that the permitee shall provide the Division, to be <br />.incorporated into the permit document, a plan for controlling sediment from <br />the distrubed area above the Homestead irrigation ditch. <br />Colorado Yampa Coal Company (CYCC) will implement the same sediment <br />control/soil stabilization measures for the small area exemption as it is for <br />the balance of the approved Mine No. 3 reclamation plan. These measures are <br />chiselling, seeding with a pastureland mixture and contour furrowing. All <br />three of these soil stabilization practices were initiated in the fall of <br />1983, with the reconstruction of contour furrows occurring during each <br />subsequent season. CYCC is confident that the reconstruction of contour <br />furrows will satisfy CMLRD concerns, and suggests that during an upcoming <br />inspection the CMLRD walk the small area exemption above the Homestead ditch. <br />If the CMLRD still has serious concerns over this area a solution will be <br />reached during the inspection and will be implemented prior to the next <br />inspeciton. <br />In regards to your letter dated April 4, 1985, suggesting straw bale berms <br />above the small area exemption, CYCC feels that the poor success seen in our <br />permanent gullies at Mine 1 and Eckman Park due to elk browsing does not <br />justify continued use of straw bales. Other secondary sediment control <br />practices are available to control sediment if the area shows significant <br />sediment loss, however, this is not the case in the small area exemption. <br />
