This report is submitted in compliance with <br />Stipulation No. 2 to the above referenced permit. The data collected <br />continues to indicate that the swell factors experienced at the mine are <br />consistent with those projected in the original permit application. <br />The results of seven (7) years of swell factor monitoring conducted at the <br />Kerr Mine have demonstrated that the original swell factor projection of 24 <br />percent is correct. Accordingly, Kerr Coal Company believes that the <br />requirements of Stipulation No. 2 have been fully satisfied. Kerr hereby <br />requests approval from the Colorado Mined Reclamation Division to terminate <br />further swell factor monitoring at the mine. <br />If you have questions regarding the information contained in this report or <br />need further clarification to approve our request for termination of future <br />monitoring, please do not hesitate to contact me at your convenience. <br />Very Truly Yours, <br />ACZ Inc. <br />David R.
