Cattany <br />Acting Division Director <br />The Division of Minerals & Geology received your letter on November 25, 2002 regarding additional <br />time to address the Division's concerns regarding the nonconforming use status of the cement kiln plan[ <br />located at [he Lyons Mine, Permit No. M-1977-208. The Division will grant a 30-day extension in order <br />to address the Division's concerns. Therefore, please address the Division's October 28, 20021etter by <br />December 30, 2002. If no response is received by this date, the Division will initiate recalculation of the <br />financial warranty to remove the cement kiln facility as approved in the initial reclamation plan of 1977. <br />In regazds to the fire fuel-testing program, the Division sent a letter to Banks & Gesso on November 20, <br />2002 regarding this issue. Please find a copy of the letter for reference. Since the writing of that letter, <br />the Division has been in contact with Violet Sykora, Environmental Manager of Hocim. Apparently, the <br />Holcim Portland plant burns tires for part of their fuel. Ms. Sykora sated that using Holcim s process, [he <br />tire ash - if there is any at all -winds up in the clinker, and the clinker is ground up and added their <br />product. Hence, there is no tine ash to backfill. <br />Ms. Sykora said that she would be glad to talk with someone at CEMEX Lyons about this issue as it may <br />be of interest to the industry. She is interested in talking more with company people who have an <br />understanding of chemistry related to this issue. The Division recommends [hat CEMEX contact Violet <br />Sykora at Holcim at 719-784-1306, and see whether CEMEX even needs to be testing the ash material as <br />a result of tire burning.
