OF NATURAL RESOURCES <br />4;e have completed a sediment control plan for the Bear No. 1 Ftine as <br />we discussed recently. The plan consists of a diversion ditch which <br />will control surface runoff from the disturbed area of the Mine No. 1. <br />Three Filter Dams/"Dugout" Ponds have been incorporated into tfie <br />diversion ditch to ensure that sediment in any runoff water mill be <br />trapped. <br />Construction of the diversion ditch and Filter Dam/"Dugout" Ponds will <br />be completed as soon as practical. As you are aware, the Colorado <br />Department of Highways has recently begun construction and realignment <br />of Highway 133 which passes near the Bear No. 1 Mine. As a result of <br />this construction activity, the North Fork of the Gunnison River is <br />being relocated to the south. This construction work is not yet <br />complete. <br />The Bear Coal Company plans to construct the diversion ditch and <br />dugout Filter Dam/"Dugout" Ponds Tahen we have received specific <br />information from the Colorado Department of Highrays indicating that <br />all river relocation and other disturbance on tlTe Bear No. 1 I.1ine area <br />is complete. Due to the current highway construction activity, the <br />Bear Coal Company cannot immediately construct the diversion ditch and <br />Filter Dam/"Dugout" Ponds and ensure that they will not be destroyed <br />or 'damaged~by the Highway Department activities. <br />The attached sediment control plan shows the proposed location of the <br />diversion-ditch and Filter Dam/"Dugout" Ponds as related to current <br />Colorado Department of Highway construction activity. If additional <br />area is utilized to the south by the Department of Highways, the <br />diversion will be shifted to ensure that it will function as a <br />sediment control device. 4Je have also provided a sizing calculation <br />for the ditch for your information. <br />1 <br />
