<br />-3- <br />to retain the most valuable information on water quality conditions at <br />specific locations and critical time or flow conditions. A revised <br />NPDES permit was also approved by the Department of Health during the <br />first half of the permit period. This allowed separate discharge <br />points for mine pumpage and sediment pond discharges where these two <br />were formerly combined as a single discharge from the pond. NPDES <br />reports have been regularly submitted during the period. <br />A revised subsidence monitoring program was put into effect during the <br />first half of the permit period. Four quarterly surveys recently <br />completed were reported with a fifth survey to follow in order to <br />define baseline conditions. A reduction to an annual survey following <br />this last measurement is suggested (see Revisions Required" <br />Section). This continued monitoring, along with the operator's <br />commitment to completion of a photographic record of all potentially <br />affected structures, should ensure compliance with subsidence <br />monitoring requirements during the permit period. <br />II. DECISION TO REQUIRE RE4ISION <br />Based on this review at the mid-term of the permit period, the Division <br />finds that certain revisions and modifications are needed to ensure <br />future compliance with the Colorado Surface Coal Mining Reclamation Act <br />and Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. The section which follows details the revisions required, <br />justification for requiring the revisions and timetable for submitting <br />the revisions. The response from Grand Mesa Coal Company should follow <br />the procedures defined for a technical revision to the permit and <br />should be submitted within 60 days of receipt of this mid-terns report. <br />Revisions Required at Mid-term <br />Based on the review of the Red Canyon Mine Permit presented above, the <br />Division finds that the following revisions are required at the <br />mid-term of the permit period: <br />1. The recent change of address and phone number of the local <br />office and general office needs to be updated on the permit <br />application (page 1) and submitted as a revised page for <br />insertion in the permit document. The permittee should also <br />change this information on mine identification signs as needed <br />within 30 days. <br />2. The modification of the existing federal coal lease D-055156 as <br />described in the Colorado State Office of the Bureau of Land <br />Management environmental assessment No. CO-030-U84-38 <br />(November 9, 1984) needs to be included in the description in <br />the permit. Appropriate page revisions should be submitted. <br />
