<br />December 15, 1992- Basin Resources contacted the Division regarding <br />further extension of the deadline to December 23, 1992 followed up <br />with a letter. I stated on the telephone that the DOW must be <br />notified and approve the extension before the Division can grant <br />approval. DMG Letter was sent out on December 17, 1992 informing <br />Basin Resources to contact DOW for approval. <br />December 17 & 18- Phone call from Krassa, Lindholm, Kumli & <br />Madision representing Richard Babnick stating that Basin Resources <br />was still drilling on hole NM-4 as of this date. <br />December 21, 1992- The Division received a Written citizen <br />complaint from Richard Babnick requesting an inspection of NOI X- <br />92-213-00. <br />December 22, 1992- A citizen complaint inspection was conducted. <br />Drilling activity was not being conducted on the date of the <br />inspection. Mr. Ossola of the Las Animas County Planning and Land <br />Use Office attended the inspection as suggested by Robin Byers of <br />Krasa, Lindholm, Kumli & Madison attorneys of law. Ron Thompson of <br />Basin Resources stated that drilling continued on December 15, 16, <br />17 and 18. The Division issued NOV X-92-O1 based on this <br />information. <br />December 22, 1992- NOV X-92-O1 was terminated. <br />January 6, 1993- Basin Resources requested NOV X-92-O1 be vacated. <br />January 12, 1993- Director of DMG, Michael Long, denied request to <br />vacate NOV X-92-O1. <br />January 15, 1993- Proposed civil penalty to Basin Resources in the <br />amount of $2,000.00. <br />January 22, 1993- Basin Resources request for assessment conference <br />for NOV X-92-O1. <br />February 12 1993- Assessment conference held at DMG <br />cc: Larry Routten <br />Joe Dudash <br />Ron Thompson <br />a:/930211 <br />
