14. Specific approvals have been granted. These approvals are addressed in the following section, Section B (2.07.6(2)(m)). 15. The Division finds that the activities proposed by the applicant would not affect the continued existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats (2.07.6(2)(n)). 16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of Mazch 13, 1998, the operator is current in the payment of reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). Section B -Rule 4 Roads -Rule 4.03 A. Haul Roads The Division has approved the retention of a portion of the haul road depicted on Map No. 8 since it is compatible with the approved post-mining land use, and a request for its retention was submitted by the landowner (4.03.1(1)(f)(I)). B. Access Roads The landowner has requested the retention of the access road depicted on Map No. 8. Its retention is compatible with the approved post-mining land use of pasture land. Therefore the Division has approved retention of the access road (4.03.2(1)(f)). II. Support Facilities -Rule 4.04 A. With the exception of the facilities that were requested by the landowner to remain at the conclusion of mining; two maintenance buildings, two trailer houses, and porions of access and haul roads, all support facilities were removed from the site. Accordingly no specific findings regarding support facilities are required. III. Hydrologic Balance -Rule 4.05 A. Water Quality Standards and Effluent Limitations The applicant has demonstrated those sediment ponds and/or treatment facilities were no longer necessary for drainage to meet the effluent limitations of 4.05.2 and the applicable State and Federal water quality requirements for downstream receiving waters. Therefore, the Division approved removal of all sedimentation ponds in July 1997. On November 4, 1997, the Colorado Department of Health approved termination of the Mine's NPDES Permit since there were no longer any point source discharges. (4.05.2(3)(a)).
