14. Specific approvals have been granted. These approvals are addressed in the following section, <br />Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse modification <br />of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of Mazch <br />13, 1998, the operator is current in the payment of reclamation fees required by 30 CFR Chapter <br />VII, subchapter R (2.07.6(2)(0)). <br />Section B -Rule 4 <br />Roads -Rule 4.03 <br />A. Haul Roads <br />The Division has approved the retention of a portion of the haul road depicted on Map <br />No. 8 since it is compatible with the approved post-mining land use, and a request for <br />its retention was submitted by the landowner (4.03.1(1)(f)(I)). <br />B. Access Roads <br />The landowner has requested the retention of the access road depicted on Map No. 8. <br />Its retention is compatible with the approved post-mining land use of pasture land. <br />Therefore the Division has approved retention of the access road (4.03.2(1)(f)). <br />II. Support Facilities -Rule 4.04 <br />A. With the exception of the facilities that were requested by the landowner to remain at <br />the conclusion of mining; two maintenance buildings, two trailer houses, and porions <br />of access and haul roads, all support facilities were removed from the site. Accordingly <br />no specific findings regarding support facilities are required. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />The applicant has demonstrated those sediment ponds and/or treatment facilities were <br />no longer necessary for drainage to meet the effluent limitations of 4.05.2 and the <br />applicable State and Federal water quality requirements for downstream receiving <br />waters. Therefore, the Division approved removal of all sedimentation ponds in July <br />1997. On November 4, 1997, the Colorado Department of Health approved <br />termination of the Mine's NPDES Permit since there were no longer any point source <br />discharges. (4.05.2(3)(a)). <br />
