Lochhead <br />&eculive Dnector <br />Michael B. long <br />RE: NCIG Financial (Coal Ridge Mine) fi Western Slope C~'r'd49$ifeCOf <br />AVS; Peter Matthies <br />A few months ago, I notice in the Applicant Violator System (AVS) <br />that Peter Matthies was once an officer of Western Slope Carbon. <br />Western Slope Carbon was the operator and permittee of the Hawk's <br />Nest Mine when the bond was forfeited in 1989. Peter Matthies is <br />listed as a vice president of Western Slope Carbon in the permit <br />application and in the AVS with a beginning date of 6/7/83. <br />In the Coal Ridge permit, Peter Matthies is listed as the resident <br />agent of NCIG. Under the definition of "owned or controlled" in <br />section 1.04(83a) is defined as having any other relationship which <br />gives one person authority directly or indirectly to determine the <br />manner in which an applicant, an operator, and other entity <br />conducts surface coal mining operations. In my limited involvement <br />with the Coal Ridge Mine, Peter Matthies may fall under the <br />definition of "owns" or "controls" as described above. If he is <br />deemed as an owner, controller, operator etc... as defined under <br />this regulation, the Coal Ridge Mine is linked to the Hawk's Nest <br />mine bond forfeiture. <br />I recommend that we do the following; <br />1. Determine if Peter Matthies meets the definition of "owned or <br />controlled" in the regulations. If he does not meet this <br />definition, I believe that it is in his best interest to <br />clarify his involvement with the Hawk's Nest Mine mentioned <br />below. <br />2. Determine if Peter Matthies was indeed an officer of Western <br />Slope Carbon during the time of the bond forfeiture. Peter <br />Matthies needs to submit to the Division any proof of <br />resignation from Western Slope Carbon in the form of a <br />resignation or corporate minutes. <br />3. Update the permit and AVS to reflect any changes. <br />Please see enclosures for clarification. <br />
