The Division has completed its second review of the above referenced
permit application and has reviewed supplementary information submitted
by Colina Oro Molina (COM) as well as third party written comments that
have been received. In addition, the Division has met with
representatives of COM, Inc., regarding contents of the application and
administrative procedures, on both February 21, 1995 and on March 7, 1995.
Also, a pre-operational inspection of the site was conducted on February
28, 1995.
COM, Inc. is under a Board Order to obtain a permit by June 14, 1995. In
order to obtain a permit, the application will have to be approved by the
Division, and the bond amount established through the review process will
have to be posted by COM, Inc. and accepted by the Division. Before the
Gold Hill Mill application can be approved by the Division you will need
to address the following adequacy items in order to satisfy the applicable
requirements of C.R.S. 34-32-101, et. seq. and the Mineral Rules and
Regulations of the Mined Land Reclamation Board. Please Provide a
response to each item by May 1, 1995 in order to facilitate a June 14,
1995 permit issuance date.
1. In the Division's adequacy letter dated January 4, 1995, it was
specified that COM, Inc. redraw the proposed permit area boundaries to
include all existing surface disturbances related to the milling
operation. On the subsequent maps that have been submitted, the permit
area boundaries (a solid, heavy, black line as depicted in the map
explanation) have not been redrawn. At a minimum, the section of road
between the mill and the tailing impoundment must be included into the
permit boundary (this does not necessarily mean that the road would have
to be obliterated, it could be cleaned up, bladed, and stabilized against
erosion, then left as a permanent reclamation feature). Also the area
where the Left Hand Creek pump station is established must be included in
the permit area and depicted on a map. If there are any surface
disturbances related to this operation at the Time Mine or the Hazel A
adit, they must be included in the permit area and depicted on a map. All
