BANTA, Dlreetor
June 23, 1989
Mr. John Talfy
Kaiser Coal Corporation
P.0. Box 1107
Raton, New Mexico 87740
RE: Surface Owner Notification -Hawk's Nest Mine Reclamation
Dear Mr. Talfy:
The Mined Land Reclamation Division will be performing final reclamation work
at the Hawk's Nest Mine beginning in August of this year. The operator,
Western Slope Carbon, Inc., failed to meet regulatory requirements for an
extended period of time. This failure to comply resulted inrevocation of the
mining permit and forfeiture of the reclamation performance bond being held by
the Division. As part of the reclamation process, the Division needs to
provide notification of the impending reclamation work to all surface owners
of the area to be reclaimed. Information in the original Hawk's Nest Mine
Permit application indicated that a majority of the surface area to be
reclaimed was owned by U.S. Steel and leased to Western Slope Carbon, Inc. As
U.S. Steel's assets were acquired by Kaiser in recent years, it appears that
Kaiser Coal Corporation or one of the newly created Kaiser entities resulting
from bankruptcy reorganization now owns the surface to be reclaimed.
In an effort to ensure that appropriate individuals within Kaiser have been
adequately notified, the Division is sending this letter to you and to
Bill Pecharich of The Somerset Mine in Somerset, Colorado. If you feel that
other individuals within the Kaiser organization should be notified, or if you
have more accurate information regarding the present surface owner(s) of the
U.S. Steel surface leases in the area occupied by the Hawk's Nest Mine surface
disturbances, please contact the Division as soon as possible so that the
appropriate entities and/or individuals can be properly notified.
Please contact me at (303) $66-3567 if you have any questions.
Sincerely,
/ ~ ~~
Tom D.
