<br />Samuel Gonzales ("Gonzales") will be heard by the Honorable <br />Judith A. Boulden, United States Bankruptcy Judge, on November <br />16, 1993 at the hour of 2:30 p.m., in Judge Boulden's courtroom <br />located on the third floor of the Federal Courthouse Building <br />located at 350 S. Main Street, Salt Lake City, Utah. The Motion <br />requests approval of a settlement of a District Court case <br />between the parties. Gonzales brought the action against C&W <br />under the Federal Employers' Liability Act, 45 U.S.C. § 51, et <br />se ., alleging that he sustained certain injuries as a result of <br />C&W's negligence. The parties have agreed to settle the matter, <br />with C&W making a payment of $267,500 to Gonzales in <br />consideration for which Gonzales will pay any amounts owing to <br />the Railroad Retirement Board and will fully release C&W and new <br />c&W and all affiliated companies, their directors, officers, <br />employees, agents, successors and assigns from any and all claims <br />now or in the future, and waiving the right to exercise any <br />seniority rights or return to work. All amounts required to be <br />paid by C&W to Gonzales and the Railroad Retirement Board in <br />excess of $250,000 will be paid by C&W's insurance carrier. <br />Copies of the Motion and the related Release may be obtained by <br />request from the undersigned counsel for C&W. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule <br />523(e) of the Rules of Practice of the United States Bankruptcy <br />Court for the District of Utah, objections to the Motion must be <br />-2- <br />
