Attached to that original <br />consent was a Work Narrative which differs from the one attached to <br />copies of the consent in my realty file, and which was signed by <br />Energy Fuels, lessee of the property. Dr Corley sent his daughter <br />Anne to our office to obtain the work narratives. A copy of the <br />original consent and work narrative was given to her. The original <br />consent does not contain the description of backfilling work (see <br />attached copies of Work Narratives), <br />I believe the whole question of whether or not we were <br />"Trespassing" on Dr. Corley's land is ridiculous. Half the <br />"problem" rests squarely on Dr. Corley. Although there appears to <br />be a minor discrepancy in the consent documents, I kept Dr. Corley <br />verbally informed of the work we planned to do, including the <br />backfilling work. I specifically discussed our plans to do the <br />backfilling work on at least two occasions. I also asked if he had <br />any questions or concerns, and never received any indications that <br />he did. Dr. Corley never indicated a problem with consent or <br />permission until the morning of Monday, July 26. This is after he <br />in fact gave consent to the backfilling work on Friday, July 23 <br />1993, in an agreement he made with our contractor (see copy of <br />attached letter to Corley from Golden Drilling}. Dr. Corley cashed <br />the payment check referred to in the letter, in effect <br />acknowledging the consent agreement in writing. <br />In my opinion, the whole matter boils down to the fact that Dr. <br />Corley has seized upon a minor technicality to cause the Division <br />as much trouble as he can, in retaliation for other events not <br />connected with the Pioneer Canon Project. Technically we did not <br />have his permission to do the backfilling work in writing prior to <br />our beginning the work. However, technically we do have his <br />permission to do the backfill work in writing per his agreement <br />with the contractor, which he made on July 23, 1993.
