The subject area will be mined to <br />serve as a ramp within and adjacent to the immediate West Pit <br />mining area. As such, per Rule 1.04 (iii) "Road" this particular <br />roadway is specifically excluded from further regulation as a <br />"road". <br />Section 11 Pit <br />We believe the referenced row of transplanted serviceberry is <br />located in the Section 16 Pit rather than the Section 11 Pit. <br />East Pit <br />The subject of natural drainages in the vicinity of highway 13 <br />are worthy of further discussion. A number of important points <br />should be made as follows: <br />1. The pre-existing erosion gullies and headcuts are a <br />direct result of initial state highway construction <br />through the colluvial deposits. While we assume the <br />colluvial deposits were historically deposited in a <br />naturally meandering pattern, it is clear that the <br />construction by the Department of Transportation (DOT) <br />through the deposits would have caused the initial <br />downcutting and erosion at the crest of each road cut. <br />Colowyo is not responsible for these gullies and headcuts <br />
