Prior to receiving patent to your claim,. you were authorized to <br />maintain the private access road across National Forest System land under <br />authority of the Forest Service regulations governing use of Forest lands in <br />connection with operations authorized by the U.S. mining laws (36 CFR 228). <br />Now that you have received patent to the claim, these regulations no longer <br />apply. <br />Your right of access to the claim is now governed by Forest Service <br />regulations dealing with land uses (36 CFR 251, Subpart D). A copy of these <br />regulations are enclosed. These regulations provide that landowners shall be <br />authorized such access as the Forest Sez^~ice deems to be adequate to secure <br />them the reasonable use and enjoyment of their land. We have determined that <br />continued maintenance and use of your existing access road is necessary in <br />order for you to continue quarry operations.
