Box 1489 <br /> Fort Collins, CO 80522 <br /> RE: Completeness Review of Application for Certificate of Designation <br /> Varra Coal Ash Pilot Project <br /> Weld County <br /> Dear Mr. Adams: <br /> As you are aware, on April 6, 1999 the Hazardous Materials and Waste Management <br /> Division of the Colorado Department of Public Health and Environment (the Division) <br /> received an application for Certificate of Designation, prepared for Varra Companies by <br /> CGRS, for a pilot project where coal combustion ash would be disposed in saturated <br /> conditions. The pilot project is part of Varra's proposed reclamation plan for areas <br /> previously mined for gravel in Weld County. The Division determined the application <br /> was incomplete and discussed the deficiencies in a letter dated May 3, 1999. <br /> A revised application, dated June 26, 2000, prepared by CGRS was received by our <br /> office on June 29, 2000. CGRS's June 26th document represents a formal response to the <br /> Division's May 3, 1999 letter. In accordance with the solid waste statute, CRS 30-20- <br /> 100.5 et seq. and corresponding regulations 6 CCR 1007-2 (the Regulations), and <br /> specifically section 1.6.5 of the Regulations, the initial examination for completeness has <br /> been done within thirty (30) days of receipt by the Division. This letter is to serve notice <br /> that the revised application dated June 26, 2000, as submitted, has been detemlined to be <br /> complete. <br /> This initial decision concerning completeness does not imply or indicate anything about <br /> the outcome of our subsequent comprehensive technical review, nor does it prevent our <br /> asking the applicant to provide additional information or clarification of items in the <br /> application. <br />
