• Energy Fuels will remove all sediment fences before final bond release. <br />• Remove and regrade entire berm at west end of the southern loadout, including <br />the "speed bump" in the road. <br />• Remove and regrade entire berm located directly north of the end of the rail spur <br />in the southern loadout. <br />• With completion of the three (3) aforementioned items the bond may be released. <br />The Division conducted an inspection of the Santa Fe Loadouts No. ]and 2 on November <br />17, 1995. Representatives of Energy Fuels Mining Company and Atchinson, Topeka and <br />Santa Fe Railroad (AT&SF) accompanied the inspection. The three items identified in the <br />AT&SF letter dated November 14, 1995, had been accomplished as per AT&SF satisfaction. <br />All coal loading structures and equipment under the control of Energy Fuels Mining <br />Company have been removed. All coal stockpiles have been removed from the loadout <br />sites. A portable vertical conveyor and a stockpile of rails are situated on Santa Fe I.oadout <br />No. 1, while logs are frequently stored on the Santa Fe I-oadout No. 2. The November 14, <br />1995 letter from ATBrSF confirms that these materials and equipment are not the <br />responsibility of Energy Fuels Mining Company and do not need to be removed. <br />The loadouts have been graded in accordance with the approved permit. All berms have <br />been graded out at the Santa Fe No. 2 Loadout, as requested by AT&SF. Drainage control <br />at the Santa Fe Loadout No. 1 consists of a slight swale which directs surface runoff to the <br />north end of the permit area, into a box culvert, owned and maintained by AT&SF. The <br />Santa Fe I.oadout No. 2 has been graded to direct surface runoff to the south to a collection <br />ditch. All silt fence has been removed from both loadouts. Water drains away from the <br />rails as requested by AT&SF. <br />Proposed Decision for Phase I Bond Release <br />The Division finds Santa Fe Loadouts No. 1 and 2 in compliance with backfill, regrading <br />and drainage control requirements. The Division has estimated that $8,963.00 would have <br />been necessary for full reclamation of the Santa Fe Loadouts. The Division proposes to <br />approve a release of 60% of the $8,963.00, to $3,585.00. <br />Phase II <br />Rule 3.03.1(2)(b) states <br />Up to eighty-five percent of the applicable bond amount shall be released upon the <br />successful establishment of revegetation in accordance with the approved reclamation <br />plan. Such release shall be based on the costs of reclamation activities, including but <br />riot limited to replacement of topsoil, seeding irrigating and fertilizing; <br />The Santa Fe Loadouts No. 1 and 2have apost-mining land use of industrial.
