Box 226 <br />Delta, Colo. 81416 . . - <br />Office: (303) 874-7561 <br />Mine: (303)856-6402 <br />L..+~.'.. ,. <br />~.:. .... -......:s <br />Special Condition No. 1 of Federal Permit CO-0071 states in part: <br />"the permittee shall implement the mitigation measures identified <br />by the U.S..FWS in its draft biological opinion dated July 9, <br />1984, and submit proof of such compliance to the regulatory authority <br />and O.S.M. Compliance shall be a contribution of $1,390.00 to the <br />Upper Colorado River Fishes Conservation Fund Administered by the <br />U.S. FWS. <br />Attached you will find the copy of the check to the U.S. FWS. The check and a <br />copy of this letter are being sent to: <br />Galen Buterbaugh <br />Regional Director <br />U.S. Fish and Wildlife Service <br />P.0. Box 25486 <br />Denver Federal Center <br />Denver, Colorado 80225 <br />Grand Mesa Coal Company (GMCC) does not believe that the above special condition <br />and the resultant mandatory contribution are appropriate. GMCC recently received <br />the U.S. FWS biological opinion for review. This document is dated August 2, <br />1984. It is assumed that minor changes in the opinion have been made since the <br />July 9, 1984 draft. The biological opinion uses the following rationale to <br />determine that GMCC must donate $1,390.00 to the Fund: <br />
