-~ I II II III III IIII III I <br /> 999 <br />Proposed Decision <br />The Center Ridge Area <br />Bond Release Request <br />Edna Mine <br />File No. C-80-001 <br />Introduction <br />This document presents the results of the Division's review of Pittsburg and <br />Midway Coal Mining Company's (P&M) request for full bond release of <br />November 18, 1989. This request for bond release was deemed complete on <br />January 8, 1990. This request for bond release is in accordance with <br />Rule 3.03.2. This review was conducted to fulfill the requirement of <br />Rule 3.03(2) and 3.03.2(5)(a). <br />Rule 3.03.2(2) requires the Division to conduct a field inspection and <br />evaluation of the reclamation work involved after a request for bond release <br />has been received. The inspection to fulfill this requirement was conducted <br />as scheduled on May 9, 1990. The Office of Surface Mining was notified of the <br />scheduled inspection on April 13, 1990 but declined to be at the inspection. <br />The surface owner for the area of requested release is P&M. Messers <br />B. Gontarek, D. Beverlin and T. Crowner of P&M accompanied J. Clayton of the <br />Colorado Mined Land Reclamation Division during the inspection. <br />Rule 3.03.2(5)(a) requires the Division to propose a decision on the bond <br />release request and to provide written notification of the decision to the <br />permittee and other interested parties within thirty days of the inspection. <br />This proposed decision is subject to scrutiny by the permittee, other <br />interested parties and the United States Department of the Interior, Office of <br />Surface Mining Reclamation and Enforcement. The Division's decision shall <br />become final within thirty days of its issuance unless a written request for <br />an adjudicatory hearing is received. This document includes the proposed <br />decision and the evaluation as well as a discussion of bond amounts to be <br />retained and released. <br />-1- <br />
