<br />Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve with one <br />stipulation, an application for renewal of a valid, existing permit. This <br />document is an approval of a mining and reclamation permit, allowing only <br />reclamation at the site. <br />The application was submitted by MINREC, Inc. for the Red Canyon Mine. This <br />decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface Coal <br />Mining Reclamation Act, CRS 39-33-101 et sea., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decision, <br />then this decision becomes final. The applicant currently has an acceptable <br />surety for $74,000.00. The permit application, all supporting documentation and <br />any stipulations or conditions will become a binding part of the permit. Two <br />(2)stipulations appeared in the Findings Document of June 14, 1993. Stipulation <br />11, added during the 1993 permit renewal (RN-02), was complied with March 24, <br />1999. Stipulation No. 6 remains active. No additional stipulations were added <br />during this permit renewal (RN-03). <br />Stipulation No. 6 <br />THE PERMITTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC REPORT BY <br />DECEMBER 1 OF EACH YEAR. THIS REPORT SHALL CONSIST OF AN <br />ANALYSIS OF ALL MONITORING DATA COLLECTED BETWEEN OCTOBER 1 <br />AND SEPTEMBER 30 OF EACH YEAR FOR 1) SURFACE WATER, 2) GROUND <br />WATER, 3) MINE INFLOWS, 4) CONSUMPTIVE USE OF WATER IN THE <br />MINE, AND 5) IMPACTS OF MINING ON THE QUALITY AND QUANTITY OF <br />GROUND AND SURFACE WATERS DURING THE PAST YEAR. THE <br />HYDROLOGIC REPORT FOR 1983 IS TO BE SUBMITTED WITHIN 60 DAYS <br />OF PERMIT ISSUANCE. <br />2 <br />
