• CHRONOLOGY <br />West Elk Mine <br />Federal Lease C-1362 <br />Mining Plan Decision Document <br />DATE EVENT <br />September 9, 2005* The State Historic Preservation Office provided its comments on <br />the mining plan. <br />May 23, 2007 Mountain Coal Company, L.L.C. submitted the permit application <br />package (PAP) under the approved Colorado State Program to the <br />Colorado Division of Reclamation, Mining and Safety <br />(CO-DBMS) for a permit revision at the West Elk Mine. <br />July 24, 2007 CO-DBMS proposed approval of Technical Revision 109 to <br />Colorado State permit C-1980-007. <br />August 1, 2007 MCC published in the Delta County Independent the notice of <br />CO-DBMS' proposed decision. <br />• August 2, 2007 The U.S. Fish and Wildlife Service provided its final consultation <br />comments on the mining plan. <br />August 8, 2007 The Bureau of Land Management provided its findings and <br />recommendations on the approval of the mining plan, with respect <br />to the Resource Recovery and Protection Plan. <br />August 13, 2007 CO-DBMS proposed decision for Technical Revision 109 to <br />Colorado State permit C-1980-007 became final. <br />August 17, 2007 The Federal land management agency, USDA Forest Service, <br />issued its Record of Decision for its concurrence with the approval <br />of the mining plan with respect to the management of Federally- <br />owned lands under its control. <br />October 15, 2007 The USDA Forest Service provided its formal concurrence with <br />the approval of the mining plan with respect to the management of <br />Federally owned lands under its control. <br />* The Deer Creek Shaft was originally submitted as Technical Revision 104 (TR-104) on August 25, 2005, and <br />declazed Administratively Complete on September 1, 2005. Mountain Coal Company, L.L.C. later withdrew <br />TR-104 on June 6, 2006, and resubmitted it as TR-109 on May 23, 2007. <br />• <br />
