consists of the construction of a ventilation and emergency escape way shaft on 1.90 acres <br />of Federal lease C-1362 within the area covered by Colorado State permit C-1980-007, <br />in: <br />Township 13 South, Range 90 West 6`~ P.M. <br />Section 32, a portion of the NE'/vNE~/a. <br />This mining plan modification is necessary under 30 CFR 746.18(d)(5) because the <br />USDA Forest Service with cooperation of OSM and BLM prepared an Environmental <br />Impact Statement for the future construction of the Deer Creek Shaft and up to 168 <br />methane drainage wells on 146 well pads over the next twelve (12) years. <br />The life of the mining operations is expected to continue for an additional eight (8) <br />years under Colorado Permit C-1980-007 and this proposed mining plan modification. <br />The average annual production rate and the maximum production rate would not change. <br />The approved State permit area will not increase from its present approximate 15,638 <br />acres. <br />Surface disturbance within the approved State permit area will increase by 1,90 acres <br />from its present 398.38 acres to a new total of 400.28 acres. <br />• This mining plan modification will not add any more acres of Federal surface lands or <br />tons of Federal coal to the approved mining plan area shown on the map included with <br />this decision document. <br />The post mining land use within the permit and mining plan area would not change. <br />IV. Review Process <br />The CO-DRMS reviewed the Technical Revision for the Deer Creek Shaft (and <br />Escapeway), Federal coal lease C-1362, under the Colorado State program, the Federal <br />lands program (30 CFR Chapter VII, Subchapter D), and the Colorado cooperative <br />agreement (30 CFR § 906.30). Pursuant to the Colorado State program and the <br />cooperative agreement, CO-DRMS proposed approval of the permit revision on July 24, <br />2007, and the proposed approval became final on August 13, 2007. <br />The CO-DRMS has placed no Special Conditions on this permitting action. <br />The Office of Sw face Mining Reclamation and Enforcement (OSM) has consulted with <br />other Federal agencies for compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval <br />
