Wttany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology (DMG) received your letter and enclosures concerning <br />the Well Permit, the Slope Stability Analysis and the Storm Water Management Plan for the <br />Bernhardt Resource site, File #M-2002-120. The well permit information included in the packet <br />fulfills the requirement and resolves the problem cited in the inspection report relating to the <br />groundwater being exposed in Pod 1. <br />Item number 5 in the inspection report cited the following: <br />Stipulation 4 of the permit states, "The operator shall not mine outside Pod 1 until one of <br />the following is submitted and approved by the Division of Minerals and Geology: <br />1. a site specific flood study which demonstrates that damaging levels of erosion <br />will not occur, or <br />2. plans for structures that would convey flood water safely through the azea <br />proposed for mining." <br />The operator should be aware that no such flood study or plans have been submitted to <br />the Division. <br />Please be awaze that the Storm Water Management Plan submitted with your letter does not <br />fulfill the requirements of this stipulation, and a flood study or plans for conveyance of flood <br />water is still required prior to mining outside of Pod 1. <br />Included in this letter, you will find the Division's review of the Slope Stability Analysis <br />submitted with your letter.
