-2- <br />C <br />LIST OF STIPULATIONS <br />Stipulation No. 1: <br />THE APPLICANT MUST INSTALL MONITORING WELLS IN, <br />CONDUCT PUMPING TEST ON, ANO MONITOR WATER LEVELS AND WATER QUALITY IN THE <br />ALLUVIUM OF DRY FORK, LICK CREEK, SOUTH PRONG AND HORSE CREEK ONE YEAR PRIOR <br />TO MINING WITHIN THE WATERSHEDS OF THESE STREAMS. THE APPLICANT SHALL SUBMIT <br />TO THE DIVISION THE DATA AND RESULTS OF THESE TESTS AND MONITORING ALONG WITH <br />PROJECTED IMPACTS PRIOR TO CONDUCTING MINING WITHIN ANY OF THE WATERSHEDS. <br />Stipulation No. 2: <br />IN ITS ANNUAL HYDROLOGY ASSESSMENT, THE APPLICANT <br />SHALL INCLUDE WATER QUANTITY DATA FROM THE U.S.G.S. SOMERSET MONITORING <br />STATION. SHOULD THE U.S.G.S. DISCONTINUE MONITORING AT THIS LOCATION, THE <br />OPERATOR SHALL SUBMIT ITS OWN QUANTITY MONITORING PROGRAM FOR THE NORTH FORK <br />OF THE GUNNISON. <br />Stipulation No.~3 <br />THE APPLICANT SHALL SUBMIT TO THE DIVISION COPIES OF THE REPORTS, EXHIBITS AND <br />ALL SUBSEQUENT AMENDMENTS SUBMITTED TO THE GUNNISON COUNTY PLANNING <br />COMMISSION, TITLED PROTECTION OF MINNESOTA CREEK WATER SUPPLY. <br />Stipulation No. 4: <br />ALL DATA AND REPORTS SUBMITTED TO THE STATE ENGINEERS OFFICE AND DITCH <br />COMPANIES SHALL BE COPIED TO MLP.D AS INCLUSIONS WITHIN THE QUARTERLY REPORT <br />REQUIRED UNDER SECTION 4.05.13(2) OF THE RULES AND REGULATIONS. <br />Stipulations No. 5 <br />NEITHER WEST ELK COAL COMPANY, NOR ANY SUCCEEDING OPERATOR OF THE MT. GUNNISON <br />PROJECT'S COAL LEASES AND RESERVES WILL BE PERMITTED TO MINE COAL WITHIN THE <br />MINNESOTA CREEK BASIN, UNTIL MLRD HAS RECEIVED A COPY OF AN ADJUDICATED PLAN <br />OF AUGMENTATION. <br />Stipulation No. 5 <br />THE APPLICANT SHALL SUBMif TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br />DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br />INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS, A <br />TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE (I.E. FAULT, <br />• FRACTURES, ETC). QUANTITY, DURATION, AND QUALITY (I.E. PH, <br />ELECTRO-CONDUCTIVITY AND TEMPERATURE) OF ALL INFLOWS; A TABLE CONTAINING <br />RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE MINE, AND IMPORTED <br />FOR USE WITHIN THE MINE, A DISCUSSION Of THE WATER BALANCE WITHIN THE MINE, <br />AND FINALLY A PROJECTION OF HYDROLOGIC IMPACTS OF MINING IN THE UPCOMING YEAR. <br />
