Li $x..33 «'.T.-%' ~ S~vo~~J;/ <br />In June of 2002, the Corps of Engineers, Sacramento District (Corps) issued the permit described <br />above to Four Comers Materials (FCM) for work in the Animas River north of Durango. The <br />project involved the installation of a bank armoring system and the associated diversion of the <br />active channel away from the work area. The armoring system was designed to protect ayet-to- <br />be-excavated off-stream pond from any future capture by the Animas River. <br />According to documents submitted by FCM to the Corps during the application process, the <br />original schedule intended that installation of the armoring system and excavation of the pond <br />would occur within a single season. For various reasons, the actual sequence of events has <br />differed from the original plan. Diversion of the active channel; construction of the armoring; <br />and seeding of the embankment slope and top occurred during 2003. A portion of the pond was <br />excavated in the winter of 2005; completion is scheduled for winter and spring of 2006. <br />Special Condition 3 of the Permit requires that "A monitoring report... shall be submitted to the <br />Durango Regulatory Office each year by December 1, following completion of the project and <br />for a minimum of three years after irrigation is discontinued.. °' The first monitoring report has <br />yet to be submitted. <br />A chronology of the work to date is enclosed with this letter, along with photographs of the site <br />at various stages. Excavation activities in 2005 substantially disturbed the vegetative cover that <br />developed after the 2003 seeding and mulching effort. The entire area affected by excavation of <br />the pond will be seeded and mulched in 2006, as described in the Reclamation permit issued by <br />the Colorado Division of Minerals and Geology. FCM proposes to re-seed any portions of the <br />embankment covered by GP37 #200275200 concurrent with these reclamation activities.
