C-5644) <br />continued public and coal operation access to the Drv_ For.: of ;finnesota <br />Greek area: • <br />Forest Development Road 711.2 - Dry Fork of Minnesota Greek Road. <br />Forest Development Road 711.2B - Apache Rocks Road. <br />The non-system exploration road which junctions with the Apache Rocks load <br />and goes in a generally easterly direction to West .Flatiron is not ope r. to <br />public,full-size vehicular traffic, but is necessary for continue- <br />activities associated with coal mining in the West Flat Iron area. <br />All three of these roads are granted exceptions. <br />For the purpose of: <br />The management of wetlands and floodplains are subject to Executive Ordezs <br />11990 and 11988, respectively. The purpose of the EO's are to avoid to the <br />extent possible the long and short term adverse impacts associated with the <br />destruction or modification of wetlands and floodplains and to avoid direct <br />or indirect support of new construction in wetlands wherever there is a <br />practical alternative. <br />Also, i[ is recognized that there is a direct relationship between impacts <br />on such areas and effects on water quality and aquatic ecosystems. There <br />is a high risk of irreversible and irretrievable impacts on the latter with <br />operation and developments in wetlands, floodplains and riparian areas. <br /> <br />Ic may become necessar•: for a waiver, exception or modification (WEM) te- <br />this stipulation for the operator/lessee to use the surface in the are <br />covered by this stipulation to allow for the recovery of the coal reserve.. <br />WE,`t's to this stipulation will be considered only at the time operations- - <br />are proposed, and will be subject co the Forest Land and Resource <br />Management, Plan in effect at the time of consideration, and will be subject <br />co applicable regulatory and environmental compliance requirements. <br />Granting of a WE."1 is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right co impose ocher stipulations in the same area of this leasehold if a <br />WEM is granted. <br />Conditions under which a S7E:! may be granted: <br />If it can be shown through environmental analysis and the application of <br />mitigation measures chat the impacts to wetland, floodplain and riparian <br />resources will be minimized and that no ocher alternative location for <br />facilities and activities associated with coal mining is practical because <br />of environmental effects and operational considerations (e g, economics, <br />health and safety, etc.). <br />Any changes co this stipulation will be made in accordance~vith the Land use <br />plan and/or the regulatory provisions for such changes.
