(REVISED 3-9-95) <br />Serial No. C-56447 <br />CONTROLLED SURFACE USE STIPULATION • <br />3IG CAME ~7INTER RANCE <br />Surface occupancq or use is subject to the following special operating <br />constraints. <br />Operation and maintenance of facilities associated with coal mining such as <br />roads, waterlines, water tanks, powerlines, ventilation shafts, ancillary <br />buildings, and including monitoring will be scheduled to minimize adverse <br />effects on big game (elk) from December 1 to April 30. Unscheduled use <br />will be allowed in emergency situations with notice and coordination with <br />the Forest Service. <br />Limit road use to periods when animals are not present on the winter <br />range. Restrict road use to personnel associated with operation and <br />maintenance of coal mining facilities. Recontour and revegetate to prior <br />existing conditions (to extent possible) new roads when work is complete. <br />On lands described below: <br />Portions of Sec. 14, 22, 23, and 26, T.13S., R.90W., 6th PH with winter <br />range for big game(elk) as generally delineated on the attached map dated <br />3-8-95. The map is for planning purposes only. The existence of big game <br />winter range on the ground will determine whether the stipulation applies. <br />In the event of any conflict between written clauses of this stipulacio <br />and the map, the stipulation clauses shall control. All National Fores <br />System Land within the leasehold which is classified as big game winter. <br />range for elk falls under jurisdiction of this stipulation. <br />For the purpose of; <br />Protecting big game winter range for elk. These ranges are extremely <br />important for animal survival during winter. Disturbances and habitat <br />losses may place unnecessary stress on the wintering wildlife herds and <br />cause an increase in herd morCality. <br />It may become necessary for a waiver, exception or modification (WEM) to <br />.this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the coal reserve. <br />WEH'S to this stipulation will be considered only at the time operations <br />are proposed, and will be subject to the ForesC Land and Resource <br />Management Plan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a WE.`t is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right Co impose ocher sci~ulations in the same area of this leasehold if a <br />WEM is granted. <br />Any changes to this stipulation will be made in accordance with tha land use <br />plan and/or the regulatory provisions for such changes.
