6. Fugitive dust control mechanisms must be in place, and functioning at all times. <br />7. All complaints received by the applicant concerning impacts to offsite wells, and the resolution of <br />those complaints, shall be conveyed to the Department of Planning and Development. Impacts to <br />offsite water wells, from de-watering activities, shall be responded to and resolved immediately by <br />the applicant. Disputes concerning impacts to offsite water wells may be resolved by the <br />Department of Planning and Development and may be justification for a Show Cause Hearing before <br />the Adams County Board of County Commissioners. <br />8. This site is subject to inspection from Adams County inspectors, during reasonable working hours. <br />Adams County may give notice of inspection prior to the inspection. <br />9. Pursuant to Section 11.340 of the Adams County Zoning Regulations, all operation and <br />rehabilitation standazds shall be adhered to with the mining and reclamation plans. <br />10. All trucks shall cover their loads pursuant to C.RS. 42-4-1407. <br />11. The Conditional Use Permit shall only apply to 124s' Estates Partners or its corporate successors and <br />shall not be transferable to any other party except by amendment to the Conditional Use Permit. <br />12. The mining and reclamation operations shall be completed no later than September 11, 2003. <br />13. All fluid spills such as hydraulic and oil from maintenance of equipment, shall be removed and <br />disposed of at a facility permitted for such disposal. <br />14. Mining and Reclamation shall comply with the Technical Review guidelines for Gravel Mining <br />Activities, December 1987, as adopted by Adams County under section 11.241 (7) of the Adams <br />County Zoning Regulations. <br />I5. If fuel will be stored on this site: <br />a. All fuel storage at this site shall be provided with secondary containment, which complies with <br />State of Colorado Oil Inspection Section Regulations; and <br />b. Fueling areas shall be separated from the reset of the site's surface area, and protected from <br />stormwater; and <br />c. Applicant shall provide a spill prevention plan and release prevention plan for fuel storage and <br />fueling operations. Good housekeeping shall be practiced at this site. Spill and drip containment <br />pans shall be emptied frequently and all spills shall be cleaned up and disposed of immediately at <br />a facility permitted for such disposal. <br />16. If the applicant intends to mine within 200 feet of the property line, the applicant shall either:: <br />a. Obtain written permission from the adjacent property owner; or <br />b. Complete an engineering analysis and obtain written approval from the Department of Planning <br />and Development. <br />
