• Any approval by the DMG would be temporary, with final approval contingent upon <br />approval of the application to amend, which should be submitted to the DMG within the next <br />four to six weeks. <br />• Within the next twelve months, the owner/applicant intends to subdivide the land <br />(approximately thirty acres), through which the access route would pass, for commercial and <br />light industrial use, although development could not occur until access for mining was no <br />longer needed. <br />• The access route would be for the currently permitted acreage only. The 40 acres, which the <br />applicant/operator wants to add to the permit for mining, would have a separate access point <br />onto 120'h Avenue. <br />• It was during the prolonged final steps of gaining approval of Permit No. M-2001-085 that <br />the applicant realized that access to the site from the south was possible. <br />• The applicant/operator has entered into a contract to sell the originally permitted acreage for <br />the reclaimed use of water storage; and in order to stay on track with the timing provisions of <br />this contract, the applicant/operator believes that access to the site will be needed in the very <br />near future. <br />• Adams County is taking the lead on a large project to improve 120'h Avenue between Hwy 85 <br />and Old Brighton Road that will eventually include a flyover across Hwy 85. The County <br />approved the conditional use permit with consideration given to this road construction <br />activity. <br />We hope that there is an acceptable way out of this awkward position regarding access to the <br />124`h Estates Sand and Gravel Mine and look forward to a response from the DMG.
