INTRODUCTION <br />This document is the approval package prepared by the Colorado Mined Land <br />Reclamation Division for the Chimney Rock Coal Mine Permit Revision No. 2 Deep <br />Creek, located in Archuleta County, Colorado <br />The original proposed decision and findings document was completed by the <br />Division on October 12, 1982 for purposes of bringing the Chimney Rock Coal <br />Mine (then called the Martinez Strip Mine) into compliance with Colorado's <br />Permanent Regulatory Program. Permit No. C-023-81 was issued on <br />January 7, 1983. On June 21, 1983, Chimney Rock Coal Company submitted an <br />application for Permit Revision No. 1 to Permit No. C-023-81. The primary <br />purpose of this revision was to incorporate into their permit a newly acquired <br />lease area adjacent to their existing operation. This was approved on <br />January 16, 1984. On February 1, 1984, Chimney Rock Coal initially submitted <br />Permit Revision No. 2 for the Deep Creek area. The submittal was found <br />incomplete on February 14, 1985. Chimney Rock submitted additional <br />information and Permit Revision No. 2 was found complete on March 6, 1984. On <br />April 13, 1984 Chimney Rock•Coal withdrew Permit Revision No. 2. <br />Chimney Rock Coal resubmitted Permit Revision No. 2 on October 2, 1984. The <br />resubmitted revision was found complete on October 12, 1984. A preliminary <br />adequacy review was sent to the applicant on December 14, 1984, outlining <br />outstanding concerns with the application. On February 8, February 25, and <br />March 4, 1985, the applicant submitted responses to the questions in the <br />preliminary adequacy review. On March 27, 1985 representatives of the <br />applicant and their consultants met with the Division and Office of Surface <br />Mining personnel to discuss the responses. On April l2, and 18, 1985, the <br />applicant submitted additional information and responses to the adequacy <br />review. Additional meetings on April 1 and 9, 1985, were held with the <br />applicants consultant. <br />Since that time the Division has been reviewing the responses and application <br />and preparing the following findings. <br />As a result of the addition of numerous minor and technical revisions to the <br />original permit, the satisfactory resolution of many of the stipulations which <br />were present in the original findings and permit documents, and changes in the <br />comprehensive mine plan proposed in the Revision No. 1 application, the <br />Division has determined that the most effective way to issue the Revision No. <br />2 approval package would be to prepare an entirely new findings document, <br />specifically addressing the Permit Revision 2 (Deep Creek) area. This <br />approval package does not supercede or replace the December 13, 1983 approval <br />package, but augments it for the Permit Revision No. 2 area. All commitments, <br />stipulations, and findings contained in the December 13, 1983 approval <br />package, and Revision No. 1 remain in effect, as does the mining and <br />reclamation plan. This approval package address only the Deep Creek Permit <br />Revision No. 2 area, and its interelation with the other areas of the Chimney <br />Rock Mine as necessary. <br />
