-23- <br />To monitor the efficiency of the overburden stockpile subdrains, and to <br />determine the development and quality of an unconfined aquifer within the <br />stockpile, two wells will be installed in the stockpile, each to be located as <br />indicated in the accompanying figure. Each well will be monitored monthly for <br />water lever. Well No. 1 will also be sampled, as per the previously mentioned <br />parameters, on a quarterly basis. <br />To monitor ground water flow in Deep Creek Canyon Two wells will be <br />constructed, the location of which are indicated on the accompanying figure. <br />Hole W-10 will be an alluvial/colluvial completion, while W-20 will be open to <br />the "A" and "B" seams. Each well will be monitored monthly for water level, <br />and quarterly for the previously stipulated parameters. <br />The existing and proposed operations are found to be in compliance with the <br />requirements of this section. <br />VII. Water Rights and Replacement - Rules 2.04.7(3), 2.05.6(3)(a)(ii), <br />Information pertaining to water rights and replacement for Stollsteimer Creek <br />can be found in Section 2.04.7, Volume I and Exhibit 29, Volume IV of the <br />approved permit application, and Section 2.04.7 of the Federal Lease permit <br />revision 1 application. <br />The applicant receives the right to the water used for dust suppression <br />through a written agreement with Mel Martinez, who has an adjudicated water <br />right to.8.5 cfs of Stollsteimer Creek flow. <br />There are no identified water rights on Deep Creek and no permitted wells have <br />been identified in Deep Creek Canyon. <br />The applicant's surface water control plan does not call for the permanent <br />impoundment of water. Sediment ponds at the site are the only structures that <br />would impound water, and then only in the event of a precipitation event. In <br />addition, all sediment ponds will be dewatered within 36 hours of a <br />precipitation event. This water will be discharged into the Deep Creek <br />surface water system. <br />The applicant is found to be in compliance with this section. <br />VIII. Alluvial Valley Floors -Rules 2.06.8, 2.07.6(2)(k), and 4.24 <br />Sufficient information was provided in Exhibits 7R2 and 15R2 and the PAR <br />response of February 25, 1985, to determine whether an alluvial valley floor <br />(AVF) exists in Deep Creek Canyon. <br />The Division finds, pursuant to Rule 2.06.8(c), that: <br />i. Deep Creek is held by unconsolidated streamlaid deposits; <br />
