DePtD~a~~~/~I~IDN <br />RE: Your File C-006-80, Clarification of <br />Professional Encineer Certifications <br />Dear Mike: <br />This letter is written to satisfy your verbal request for a <br />written clarification regarding professional engineer certifica- <br />tions for certain structures at the Kerr Mine and Tipple areas <br />which were in place prior to submittal and approval of Permit No. <br />C-006-80. <br />Existing Haul Road A - Map 1, Kerr Mine Area Mine Plan; Map <br />28a, Kerr Mine Area Existing Structures; Map 30, Class I Road <br />Profiles; and Figure 25a, Existing Class I Road - Typical Sections, <br />all exhibit certification statements which, with respect to Exist- <br />ing Haul Road A, were intended to certify that its existing <br />configuration ("as built") complies with the applicable rules and <br />regulations regarding Class I haul roads. <br />Kerr Tipple Sedimentation Pond and Drainage Control Structures <br />- Map 17a, Kerr Tipple Area Hydrology and Map 29, Kerr Tipple Area <br />Existing Structures, exhibit certification statements which, with <br />respect to the Kerr Tipple Sedimentation Pond and Drainage Control <br />Structures, were intended to certify that those structures, "as <br />built," were in compliance with applicable rules and regulations, <br />and had been constructed in accordance with the approved design <br />contained in Exhibit 30, Kerr Tipple Area Drainage and Sediment <br />Control Plan. <br />This should clarify any questions you have regarding certifi- <br />cations of structures which were in place at Kerr prior to permit <br />approval.
