-35- <br />Stipulation No. 8 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE APPLICANT SHALL REVISE THE PERMIT <br />APPLICATION TO INCLUDE THE PLAN APPROVED AND INCORPORATED INTO THE MCCLANE <br />CANYON PERMIT APPLICATION) FOR SURFACE MANIPULATION OF SOILS TO ENHANCE <br />MOISTURE RETENTION AND REDUCE EROSION DURING RECLAMATION. THE PLAN SHALL BE <br />INITIATED BY THE APPLICANT DURING RECLAMATION. <br />With acceptance by the applicant of the above stipulations, the operation will <br />be in compliance with the requirements of this section. <br />XII. Vegetation Information - Rule 2.04.10 <br />Baseline vegetation information for the Munger Canyon feline can be found in <br />Section 4.8 of Volume I, Sections 3.1.1 and 4.5 of Volume VI, and on Figure <br />4.5-1s of Volume VII of the permit application. The Division has reviewed <br />this portion of the application and determined that the information is <br />adequate. All previous concerns relating to the baseline vegetation <br />information section of the initial permanent program permit application have <br />been resolved, with the exception of their incorporation into the permit <br />application. <br />In the initial sampling program undertaken, inadequate numbers of samples were <br />taken to provide the current desired levels of confidence (p greater than or <br />equal to .80 for non-herbaceous communities, d = .10, alpha = 2) for the <br />productivity of the greaswood shrubland, shadscale shrubland, and juniper <br />woodland vegetation types. <br />The Salt Creek Mining Company Munger Canyon Mine contains the same vegetative <br />communities (with the exception of the Big sagebrush community) as, and is <br />located contiguously to, the Salt Creek Mining Company McClane Canyon Mine. <br />Abiotic factors affecting the occurrence of vegetation communities are <br />similar. For this reason, data from the two mine sites for productivity of <br />the above communities were compared to determine if the communities of McClane <br />and Munger Canyon were from differing populations. It was verified <br />statistically that the McClane and Munger respective communities were not <br />significantly different in terms of vegetative productivity within the bounds <br />of each vegetative community. Data from the McClane and Munger sites were <br />combined (within communities between sites), and it was determined that the <br />combined data met confidence level requirements. <br />The initial 5-year permit for the Munger Canyon Mine contained a stipulation <br />(No. 9) requiring the permittee to resample the Munger Canyon big sagebuush <br />community for production during the 1983 growing season. A satisfactory <br />response to the stipulation was received, therefore, the requirements of <br />Stipulation No. 9 attached to the initial 5-year permit are considered <br />resolved. <br />
