James Fulton <br />Chief, Denver Field Office <br />Office of Surface Mining <br />1999 Broadway, Suite 3320 <br />Denver CO 30202-5733 <br />Dear Mr.Fulton: <br />RECEIVED <br />MAY 2 4 2000 <br />Division of Minerals 8 Geology <br />We are hereby making a written request for a citizen's complaint concerning the GEC <br />Mine reclamation as performed by the Division of Minerals and Geology of the State of <br />Colorado. <br />GEC ceased operations in 1934, and it wasn't until 1937 that DMG accomplished <br />reclamation bond forfeiture. It was seven years after that in 1994 that the majority of the <br />reclamation was performed, with the amount of work possible with the bond monies <br />erroded by inflation. All interest on the bond was put into the general fund of the State of <br />Colorado and was lost for reclamation. ' <br />The supervisor of the reclamation was John Nelson of the ArvQ,. We were never <br />successful in getting any changes made durin, the reclamation to preserve some of the top <br />soil or to construct some errosion structures because Mr. Nelson would not consider any <br />of our concerns. Later, he directed the contractor to construct the concrete structures in <br />the flow line of the main drainage incorrectly, and these structures have failed. We told <br />DMG at the time that Mr. Nelson was not doing an adequate job and that he was not <br />concerned with job site safety. <br />About six months ago, DMG asked for our input about additional remedial work. We <br />suggested road replacement, which was accepted. About a month ago we were notified <br />that there was to be a prebid meeting. Only after that meeting were we given any of the <br />design specifications, and we were then advised that DNIG wanted to use an undisturbed <br />hill for fill material and that John Nelson was to be the supervisior. Subsequently we <br />discussed our concerns that the road project at about $40,000 was excessive and that <br />John Nelson should not be the supervisor. DMG agreed at first that a saving of $15,000 <br />would free up funds to do other work and that John Nelson did not have to be the main <br />supervisor. Then, a sudden reversal occurred, and the project became an "all or nothing" <br />and Nelson was mandated. We refused, and DMG cancelled the road project and notified <br />us that they would never do any more reclamation. <br />We have asked for a meeting with the Mined Land Reclamation Board, and we have asked <br />the OSM to attend the meeting.
