As <br />you are aware, Sunnyside Gold Corporation (SGC) has met with the Division in Denver on two occasions <br />(October 18, 2004 and February 3, 2005) along with several discussions by telephone and in SGC's <br />Silverton office, where these issues were extensively discussed. With this letter, SGC confirms it's <br />previously stated plans and position on the issues and questions raised and addressed below. <br />October 7, 2004 Letter <br />L Competing desires for post-mining land uses. Please explain how SGC intends to resolve the <br />post-mining land use issue. What are your plans for the building that sits -apparently - on <br />lands owned partly by Dresser and GKMC, knowing that GKMC has expressed at least a <br />desire to continue occupying that part of the building on its properly? With the possible <br />exception of the mine portal, none of the structures or parts thereof can remain unless the <br />post-mining land use is changed appropriately. The Division can still consider a request <br />for change in post-mining (and nse for this area, if SGC desires. <br />GKMC obtained the buildings from SGC, with access rights reserved in the deed for SGC to fulfill any <br />reclamation obligations, as part of a contractual agreement with GKMC. In this Agreement, GKMC is <br />required to take over reclamation responsibilities for the buildings with the MLRB. GKMC has not <br />completed this obligation.
