<br /> <br />.~ <br />Letter to Gwen Fraser 2 October 6. 1995 <br />disposed of in the approved, lined tailing impoundment. As such, the <br />Division will require that all slimes behind the Hazel-A bulkhead be <br />removed to the tailing pond, and that the Hazel-A sill be cleaned down to <br />intact rock. The procedure for the slimes removal operation must be <br />described in detail in a written submittal to the Division, which must be <br />reviewed and approved by the Division prior to initiation of the project. <br />COM, Inc. must commit to notification of the Division at least 48 hours <br />prior to project initiation in order to allow for Division inspection <br />during slimes removal. The Division will require that all slimes be <br />removed from the Hazel-A and placed in the tailing impoundment by December <br />1, 1995. This deadline may be extended, only with written concurrence <br />from the Division, for good cause shown. Examples of good cause for <br />deadline extension would be: <br />1. safety considerations for work within the adit, including the timing <br />of any required approvals from the Mine Safety and Health <br />Administration, and; <br />2. contractor availability to complete the required tailing removal. <br />In general, inclement weather would not be sufficient for a finding of <br />good cause for deadline extension. Also, any finding of good cause for <br />deadline extension would have to include a demonstration that COM, Inc. <br />had made a good faith effort to meet the December 1, 1995 deadline. <br />Photographs taken during the microscopic examination are available for <br />review at Division offices, and the Division could also provide the thin <br />sections on loan to COM, Inc. if necessary.
