<br />Judith A. Boulden, United States Bankruptcy Judge, on Wednesday. <br />September 29. 1993, at the hour of 3:00 o.m., or as soon <br />thereafter as counsel may be heard, in Judge Boulden's Courtroom <br />located on the third floor of the Federal Courthouse Buildi~iq <br />located at 350 South Main Street, Salt Lake City, Utah. The <br />Motion requests approval of a settlement of the above-captioned <br />adversary proceeding between the parties. CF&I brought this <br />action against Lasater alleging that certain transfers made to it <br />constitute avoidable preferences under li U.S.C. § 547(b). The <br />parties have agreed to settle the matter with Lasater making a <br />payment of $5,262.75 and waiving all claims against the D~abtors' <br />estates. Copies of the Motion and the related Settlement <br />Agreement may be obtained by request from the undersigned counsel <br />for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523 (b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, ands served <br />upon the undersigned counsel on or before Tuesday, Septemk~er 21, <br />1993. Absent timely filing and service of objections, the: <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br />the Motion may be granted by the Court without further notice or <br />hearing. <br />2 <br />
