Cattany <br />Acting Division Director <br />A review of the Annual Reports dated from as far back as 1998 submitted by Currier Gravel indicates <br />that there has been no activity at the above referenced permitted site since 1992. Rule 1.13.2 (1) states <br />that a condition of Temporary Cessation (TC) exist if there is no work done at the site for one hundred <br />and eighty (180) consecutive days. Rule 1.13.8 (2) allows the Mined Land Reclamation Board {MLRB) <br />to grant a five (5) yeaz tmporazy cessation that may be continued for an additional five (5) years for a <br />maximum of ten (10) years (Rule 1.13.9). Based on the information supplied by Currier Gravel, it <br />appeazs that no activity on the site since 1992 has used up the maximum ten (10) yeaz period that the <br />Rule allows. The date of TC would be set at June 29`s, 1992 by the Board. <br />If the annual reports do not reflect recent activities at the permitted site, please supply documentation to <br />amend the reports. Activities can include removal of stockpiles, grading and general maintenance. If <br />the reports are accurate, then Currier Gravel must begin final reclamation work to avoid a possible <br />MLRB hearing for failure to reclaim the site within the time required by law. <br />Staff understands that the Forest Service is the primazy user of materials from the site. An option that <br />maybe viable is to do a Technical Revision (TR) that places the permit in an intermittent use status. <br />Intermittent status does not have time frames attached to it. The Boazd would review the circumstances <br />for the TR request and may grant such status if there are measures taken to keep the site stable. A TR <br />would need to state the reasons why the permitted site is only used infrequently and documentation from <br />the Forest Service stating a continued desire to maintain the permit. <br />The Currier Pit is due for a regular Monitoring Inspection. Staff will be contacting Currier Gravel to set <br />up a date and time for this visit in late July. At that time, DMG staff will be more than happy to discuss <br />the options available in more detail and assist in cleazing up this matter. <br />
