The request is in <br />reference to a Notice of Appeal of the Division of Minerals and Geology's March 9th determination that <br />the above referenced mines meet the criteria of a Designated Mining Operation per Ru]e 7.2. <br />Therefore, Division staff has scheduled the matter for Formal Public Hearing before the Colorado Mined <br />Land Reclamation Board, for consideration. The hearine will be held in Room 318. 1313 Sherman <br />Street. Denver, Colorado, on August 16`h~17. 2006 commencing at 9:00 a.m, or as soon thereafter as the <br />matter can be considered. Please note this hearing is to establish whether to allow the intervention and <br />party status of Energy Minerals Law Center. The merit of the appeal and related issues under <br />consideration are separate from this proceeding. If the Board decides to hear the Appeal, the Board will <br />set the date for full consideration at a future Board Hearing.
