Coal Office <br />FROM: 6tephen Srown^~~ <br />Assistant Attorney General <br />Natural Resources Section <br />REs Right of Successive Renewal/Continuation of Operations <br />In your December 23, 1993 memorandum to me, you asked whether e <br />noel permittee that has not submitted a renewal application to <br />the Division at least 180 days prior to the expiration data on <br />the permit has the right to a successive renewal. You also asked <br />whether such a permittee could continue to mine and/or ship coal <br />after the date of permit. expiration until a final decision <br />regarding permit renewal ie made. Subsequently we discussed <br />whether a permittee could continue to mine after permit expira- <br />tion under the temporary relief provisions of the Regulations of <br />the Colorado Mined Land Reclamation Board for Coal Mining <br />(Regulations), 2 CCR 407-2, Section 2.07.4(d) if. the Division <br />issues a proposed decision regarding a renewal application prior <br />to permit expiration.
