Shilling, Chief <br />Mining Analysis Division <br />U.S. Department of the Interior <br />Office of Surface Mining <br />Brooks Towers <br />1020 Fifteenth Street <br />Denver, Colorado 80202 <br />RE: MINING PLAN #CO-0012-SPECIAL CONDITION #3 <br />Dear Mr, Shilling: <br />Colorado Westmoreland Inc, appreciates the review work completed on Special Con- <br />dition #3, As was requested in the letter dated April 18, 1986, Colorado West- <br />moreland commits to the followiny: <br />1. Determination of the potential for impacts to the site will be completed far <br />enough ahead of the impact for an eligibility determination to he made and <br />mitigation completed; <br />2, Testing to determine if the site is an archaeological resource will be co~~- <br />pleted so that eligibility will be determined for listing on the National <br />Register; <br />3. If the site is determined eligible for listing, CW1 will implement the miti- <br />gation plan as outlined in our submittal prepared by Centuries Research, <br />As was stated in our original submittal, CWI does not anticipate mining within <br />this area for approximately five years. The actual impacts to the area may not <br />take place based on subsidence information currently being gathered. If impacts <br />are anticipated, the testing and mitigation plan will be completed in a timely <br />manner, <br />These commitments fully satisfy Condition e3 on Orchard Valley Mininy Plan aCO- <br />0012.
