Permit No. C-81-013; February 22, <br />1994 Letter from Raton West/Baldwin Ltd. <br />Dear xr. Long: <br />This latter on behalf of Basin Resources, ins. .(Basin) <br />responds to the referenced lnttar from Raton west/Baldwin Ltd. <br />(Raton West) to the Division. Tha Raton West letter constituted <br />its preliminary comments on the Division's proposed decision to <br />renew Basin's permit !or the Golden 8agla xine, Permit No. C-81- <br />oi3. Raton West, Basin and the Division eat Wednesday afternoon, <br />February 23, in the Division's offices to diacusa the latter and <br />additional issues. This letter will attempt to summarize some of <br />those discussions and respond to certain points raised in Raton <br />Waet'a latter. <br />1. Raton Walt argued that Permit No. C-81-017 cannot be <br />renewed, because Basin missed the originai deadline for submitting <br />its renewal appiication. Therefore, Raton West argued, a new <br />permit must ba issued. That is incorrect. The issue already has <br />been addressed in an opinion of Assistant Attorney General Stephan <br />Brown dated January 21, 1994, and addressed to your office. As <br />explained by ltr. Brown on page 3 of the memorandum sited above, <br />"(b)ecause there is no explicit sanction for permit renewal for <br />failure to mast the 180 day requirement, it appears that DMG and/or <br />the xLRH, can still psocasa the renewal applications and, if all <br />other statutory and roqulatory conditions have bean met, issue the <br />permit renewals to Basin." <br />The right of successive renewal, as sat forth in CRS ]d-33- <br />109(7)(a) is separate and distinct from the right of continued <br />operation past the permit expiration data, as sat forth at CRS 74- <br />
