•I <br />I/ <br /> <br />Mr. Dave Stout -2- September 3, 1982 <br />IF SOLUTION OF THE OVERBURDEN QUALITY PROBLEM ENTAILS MODIFICATION <br />OF THE SPECIFIC DETAILS OF OVERBURDEN HANDLING AND STORAGE OR POST- <br />MINING CONFIGURATION OF THE MINED RREA, THE OPERATOR SHALL PROVIDE <br />THE APPROPRIATE REVISIONS ~ TXE MINING AND RECLAMATION PLAN. <br />Stipulation I8, 19 and 20 have to do with setting revegetation success standards <br />and methods of monitoring revegetation success. The Division and wymoning Fuel <br />Company have worked together toward satisfaction of these stipulations. It <br />appears that mutually acceptable responses to these stipulations is near, how- <br />ever Wyoming Fuel Company has not responded to the latest comments on <br />Stipulations 18 and 19 contained in a letter from Mr. Mike Savage of April 7, 1982. <br />The Division is denying Wyoming Fuel Company's request for an extension of the <br />deadlines for stipulations Z8, 19, and 20. Wyominig Fuel Company is therefore .F <br />delinquent in meeting the terms of these stipulations. The Division is not <br />taking any enforcement actions at this time but requests that Wyoming Fuel <br />Company arrange a meeting with myself and Mr. Mike Savage of the Division <br />staff prior to September 30, 1982 to resolve these stipulations. <br />I look forward to your continuing efforts toward bringing these concerns to <br />a satisfactory conclusion. <br />Sincerely, <br />Richard Domingue <br />Reclamation Specialist <br />RD:ys <br />
