LonK <br />RE: Response [o Questions Concerning Robert Krasva's Letters of February 22, 1994 and Division Director <br />February 25, 1994 and Jeff I)esautel's Letter of February 24, 1994, Basin Resources, Inc., <br />The Golden Eagle Mine, Permit No. C-81-013 <br />Per your request last week, I reviewed Bob IGassa's and Jeff Desautel's February 1994 memos regarding the <br />Golden Eagle Mino. I'd like b provide the following responses. <br />1. ICrassa's Letter of Febnrarv Z5. 1994 <br />Your first question concerned Mr. ICraasa'e commwLv in Paragraph No. 2 regarding the surface bwaers <br />overlying the Golden Fngle Mine, and the location of their properties that be alleges are missing from the <br />Surface Owner's Map. <br />At the February 23, 1994 meeting at which representatives of the Division, Basin Resoltr~ces and <br />Raton West met, an updated Surface Ownership Map was submitted to the Division by the operator. <br />Most of the information appeared correct to Raton West though at least one error was idwtified. The <br />Division has asked the two parties to coordinate on this matter. Additionally, the Division is asking <br />the two parties to agree on a cutoff date of January 21, 1994 for the surface ownership information. <br />Finally, we have asked Basin to submit updated Surface Ownership Maps to the Division on a <br />quarterly basis. <br />The nett question pertained to the status of the submittals that Mt. Krassa, in his Paragraph No. 3, stated <br />were missing. <br />The submittals were due on January 21, 1994. This day was a holiday, so the items were deGvercd <br />on January 22, 1994. Mr. Carl Gorily, representing Raton West, was unable W come to the office <br />that day. He telephoned the office that day end requestod copies of the submittals mailed to him. <br />This was done; however, the mailed copies did not arrive to him in time before the January 23, 1994 <br />meeting. f)o January 23, 1994, Mr. Gerity picked up some of the material, and the remaining <br />material was mailed again to him. The submittals of January 22, 1994 aero reviewed by the Division <br />and m adoquacy letter was sent on March 4, 1994. <br />The nett question, pertaining to Mr. Krassa's comments in Paragraph No. 4, asked if all maps encompassed <br />the entire permit area, particularly the post-mining land use map, and whUher this was caught during the <br />Division's review of the permit renewal: <br />Not all maps submitted for uederground mining operations are required to identify the permit <br />boundary. Rule 2.10.1(3) states 'All maps shall show the permit area boundaries where the area of <br />the map covers the boundaries." <br />
