We believe that any action made possible by your permit that <br />causes a depletion of water from the upper Colorado River basin should <br />prompt n "may affect" Finding for the listed fishes and necessitate <br />cousullnl.iou under the Endangered Species Act. <br />1'Ite Fisl+ attd Wildlife Service can enter into formal Section 7 consultation <br />only with anolhcr federal agency or its designee.
