The Solid Waste Section of the Hazardous Materials and Waste Management Division (the
Division) has received your letter of October 13, 1994 regarding the Gold Hill Mill. In that
letter, you request that we review the status of this facility a make a determination as to
whether or not the facility would require of Certificate of Designation.
After a review of your letter, the Division cannot at this time make a final determination
on this matter. The information provided in your letter shows that the mill and the source
of ore are owned by separate entities. This would cause the mill to be classified as a custom
mill pursuant to the October, 1992 Memorandum of Understanding between DMG and the
Division. However, based on discussions with DMG staff and review of DMG's January 4,
1995 letter regarding this facility, DMG is currently attempting to bring the facility under
a mining and reclamation permit.
Until DMG makes a final determination on the mining and reclamation permit application
for the facility, the Division will withhold a final determination on the necessity of a CD.
