In that <br />letter, you request that we review the status of this facility a make a determination as to <br />whether or not the facility would require of Certificate of Designation. <br />After a review of your letter, the Division cannot at this time make a final determination <br />on this matter. The information provided in your letter shows that the mill and the source <br />of ore are owned by separate entities. This would cause the mill to be classified as a custom <br />mill pursuant to the October, 1992 Memorandum of Understanding between DMG and the <br />Division. However, based on discussions with DMG staff and review of DMG's January 4, <br />1995 letter regarding this facility, DMG is currently attempting to bring the facility under <br />a mining and reclamation permit. <br />Until DMG makes a final determination on the mining and reclamation permit application <br />for the facility, the Division will withhold a final determination on the necessity of a CD. <br />I hope that this letter clearly states the Division's position on this matter.
