PLEASE TAKE NOTICE that the Division of Minerals and Geology of the State of
Colorado Department of Natural Resources has determined, pursuant to C.R.S.
34-33-123(7), that a pattern of violations exists as to the requirements of
Article 33 of Title 34, Colorado Revised Statutes, as the captioned mine.
Furthermore, the Division has found that such violations are caused by the
unwarranted failure of the Permittee to comply with such requirements.
If, within 30 days after service of this Order, you file with the Division a
Response to Show Cause Order and a written Request for Review of Show Cause
Order, a Formal Public Hearing, pursuant to Rule 5.03.5(3), will be scheduled
before the Mined Land Reclamation Board. Should you not file either the
Response or Request for Review, the Board, pursuant to Rule 5.03.3(3)(b), will
make findings of fact and issue a written decision, and the reasons therefor,
concerning suspension or revocation of the permit.
