<br />Section V -Decision to Require Revisions <br />As a result of this midterm review, the Division will require a revision to address the following <br />concerns with the Seneca II-W Mine permit. <br />1. Please provide the Division with a complete Table of Contents for the permit application. <br />Neither of the Division copies includes this. <br />2. Please update Appendix 3-3 of the permit application package where ownership of the H-G <br />I.oadout is concerned. <br />3. Please update Appendix 3-5, "Current and Previous Coal Mining Permits Held by Peabody <br />Coal Company." <br />4. Please update Appendix 3-6, "Compliance Information" to include any violations received by <br />Peabody Coal Company or Peabody Western Coal Company since January 1, 1991. Please <br />note that, in accordance with Rule 2.03.5(3), it is not necessary to include compliance <br />information for all subsidiaries and affiliates of PWCC. <br />5. PleBSe update Exhibits 12-2 and 13-1 to incorporate changes made during Road G and Pond <br />006 construction, and the elimination of Road H and associated structures. <br />6. Please revise Tab 13 by deleting plans for Road H construction. <br />7. Please provide construction certifications for all catchment basins listed in Tables 13-8-1A and <br />13-1-1B. <br />8. Please verify that the information contained in Tab 3, "Adjudication File" is correct, or revise <br />that section as necessary. <br />9. Table 15-2, "Ground Water Monitoring Site Summary" lists a number of wells which are <br />reported to have been damaged. We were unable to determine whether these inactive wells <br />had been properly abandoned. Please provide the Division with information concerning the <br />abandonment of inactive wells listed in Table 15-2. <br />10. Page 16-7 of the currently approved permit application includes a discussion of stream buffer <br />zones at the site. PWCC states that buffer zones are not necessary on Dry Creek and <br />Hubberson Gulch since the streams are not perennial. Monitoring data indicate that these <br />streams might be perennial. Please verify that stream buffer zones are not necessary for these <br />areas, or update the permit application accordingly. <br />Seneca 7I-W Mine Page 9 <br />
