-z- <br />Proposed Decision <br />Dorchester No. 1 Mine <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, the application for a permit to conduct coal mining by <br />Dorchester Coal Company for the Dorchester No. 1 Mine. <br />The approval decision is based on a finding that the proposed operation wi71 <br />comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 1973, as amended, 34-33-101 et seg., and the Regulations <br />promulgated pursuant to the Act. <br />The permit cannot be issued until all statutory notice and public comment <br />requirements have been satisfied, and until bond has been posted. <br />The permit application and stipulations will become a binding part of the <br />permit upon approval. The stipulations for the Dorchester No.l Mine are as <br />follows: <br />Stipulation No. 1 <br />THE OPERATOR SHALL SUBMIT RIGHT OF ENTRY INFORMATION FOR THE FLORENCE <br />CITY, A.T. MASSE Y, AND CURLEY PROPERTIES, WHERE SUBSIDENCE IS PROPOSED, <br />30 DAYS PRIOR TO AFFECTING THESE LANDS. <br />Stipulation No. 2 <br />THE OPERATOR SHALL CONTINUE ALL HYDROLOGIC MONITORING OUTLINED IN THE <br />APPLICATION AND THIS FINDINGS DOCUMENT UNTIL SUCH TIME AS THE DIVISION <br />APPROVES OF MODIFICATION OR CANCELLATION OF 7HE PROGRAM. <br />Stipulation No. 3 <br />WITHIN 180 DAYS OF PERMIT ISSUANCE THE OPERATOR SHALL PROVIDE <br />DOCUMENTATION THAT THE APPROPRIATE FILINGS HAVE BEEN MADE WITH THE STATE <br />ENGINEERS OFFICE OR APPLICABLE WATER COURT REGARDING THE STORAGE AND <br />CONSUMPTIVE USE OF WATER AT THE MINE. <br />Stipulation No. 4 <br />WITH RESPECT TO THAT PORTION OF 7HE COAL LOAD-OUT LOCATED WEST OF THE <br />COUNTY ROAD 79 IDENTIFIED AS AN ALLUVIAL VALLEY FLOOR, WITHIN TWO YEARS <br />AFTER THE COMMENCEMENT OF THE PERIOD OF EXTENDED LIABILITY AS SPECIFIED <br />IN RULE 4.15.7(5) THE OPERATOR SHALL COMPARE THE SOIL CHARACTERISTICS OF <br />THE RECLAIMED AREA WITH AN ADJACENT UNDISTURBED AREA. THIS COMPARISON <br />SHALL BE SUFFICIENT TO VERIFY THAT THE INFILTRATION, PERMEABILITY, AND <br />TEXTURAL CHARACTERISTICS OF THE RECLAIMED SOILS HAVE BEEN RE-ESTABLISHED <br />SUFFICIENTLY TO RENDER THE AREA AS POTENTIALLY FLOOD IRRIGABLE. <br />
